Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kimsin mobile application ("Kimsin", the "App", "we", "us", or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What Kimsin is

Kimsin is a crowd-sourced phone number lookup service. When users grant permission, the App reads names paired with phone numbers from their device contacts and contributes those (phone, name) pairs to a shared index. Other users can then look up an incoming phone number and see how it has been saved in the community.

Kimsin does not reveal who contributed a particular name. Search results are aggregated and ranked by how many distinct accounts have saved the number under the same name.

2. Eligibility

• You must be at least 16 years old, or the minimum age of digital consent in your country, whichever is greater.
• You must have the legal right to share the contact data on your device. By uploading contacts you confirm you have any necessary consent from the people in your address book.
• You must not be barred from using the App under the laws of your jurisdiction.

3. Your account

Kimsin uses Google Sign-In to create your account. You are responsible for keeping your Google account secure and for activity that occurs under your Kimsin account. You may delete your account at any time from Settings → Delete account.

4. Acceptable use

You agree not to:

• Use Kimsin to harass, dox, stalk, threaten, or otherwise harm any person.
• Scrape, automate, or attempt to bulk-download the lookup index.
• Upload fake, defamatory, sexually explicit, hateful, or unlawful names intended to misrepresent a phone number.
• Reverse engineer, decompile, or circumvent the App's security or rate limits.
• Use the App in violation of any applicable law, including data protection law.

We may suspend or terminate accounts that violate these rules.

5. Premium subscription

Kimsin offers a Premium subscription that removes ads and the free-tier search limit. Subscriptions are sold and billed through Google Play or the Apple App Store, subject to their respective terms.

• Subscriptions auto-renew until cancelled. Manage or cancel from your Google Play or App Store subscription settings.
• Cancelling a subscription stops future renewals; it does not refund the current billing period.
• Prices and plans may change. We will give reasonable notice in-app before any price change takes effect for existing subscribers.

6. Free tier limit

Free accounts may perform a limited number of phone lookups before being asked to subscribe. The limit is configured server-side and may change. Your current allowance is shown on the home screen.

7. Accuracy and disclaimers

Names returned by Kimsin come from other users' address books. They are not verified and may be out of date, misspelled, or malicious. Do not rely on Kimsin results for any decision with legal, financial, safety, or medical consequences.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIMSIN AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under mandatory law (for example, liability for gross negligence or wilful misconduct, or your statutory consumer rights).

9. Intellectual property

The App, its source code, design, trademarks, and content (other than user-contributed data) are owned by the operators of Kimsin and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose.

10. Termination

You may stop using the App at any time and delete your account from Settings → Delete account. We may suspend or terminate your access if you violate these Terms or if continued operation of the App is no longer feasible.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by an in-app notice. Continued use of the App after an update constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to its conflict-of-laws rules. The competent courts of Kazakhstan have exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory consumer-protection rules give you the right to bring proceedings in the courts of your home country.
